How Does Washington Law Define Domestic Violence?

Under Washington law, domestic violence refers to certain criminal allegations committed either:

  • (a) By one family or household member against another, or

  • (b) By one intimate partner against another.

Family or Household Members Include:

  • Adult persons related by blood or marriage

  • Adults currently living together, or who have lived together in the past

  • Persons with a biological or legal parent-child relationship (including stepparents, stepchildren, grandparents, and grandchildren)

Intimate Partners Include:

  • Spouses or domestic partners (current or former)

  • Persons who share a child in common (whether or not they were ever married or lived together)

  • Adults who are, or were, in a dating relationship and have lived together

  • Persons 16 years of age or older who are, or were, in a dating relationship (with or without living together)

What Happens When You’re Charged with Domestic Violence?

In most cases, the judge will issue a pretrial No-Contact Order between you and the alleged victim at your first appearance.

  • If you live together, you may request that the judge authorize a Civil Standby. This allows you to contact law enforcement so they can briefly accompany you to your residence to collect essential belongings.
