Getting Out of Jail After Arrest

After booking into the Chelan County Regional Justice Center, some people may be eligible to post bail immediately. Eligibility depends on the type of charge. For example, In Chelan County, individuals arrested for domestic violence offenses must remain in custody without bail until their first court appearance.

If immediate release isn’t possible, the individual will appear in front of a judge. At that hearing, the court decides whether the person can be released and what conditions will apply.

How Bail Works

When bail is set, it serves as collateral to guarantee court appearances. Bail can be posted in two ways:

1. Cash Bail

  • Must be paid in full and in cash directly to the jail.

  • If the defendant attends all hearings and follows all release conditions, the entire amount is returned when the case is resolved.

2. Bail Bond (Through a Bail Bondsman)

  • If the full bail amount is unaffordable, a licensed bail bond company can post it on the defendant’s behalf.

  • This usually requires paying a non-refundable fee of about 10% of the bail amount.

  • In some cases, the bondsman may also require collateral (such as property or a vehicle).

Forfeiture of Bail

Bail is not a guarantee of release without risk. If the defendant:

  • Fails to appear in court, or

  • Violates pretrial release conditions,

the court may revoke release and forfeit bail, meaning:

  • Any cash bail posted will not be returned.

  • The defendant may be taken back into custody.

  • If a bail bond was used, co-signers or collateral may be held responsible.
